🇩🇪 ALLGEMEINE GESCHÄFTSBEDINGUNGEN (AGB)
1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Verträge zwischen
[Dive3d.eu – Moormerlandstr 39 – D-26802 Moormerland]
und Verbrauchern (§ 13 BGB) sowie Unternehmern (§ 14 BGB),
die über diesen Online-Shop digitale Inhalte erwerben.
2. Vertragsgegenstand
Gegenstand des Vertrages ist der Verkauf von digitalen Inhalten in Form von 3D-Druckdateien (STL-Dateien).
Die Lieferung erfolgt ausschließlich digital per Download.
Ein Versand von physischen Waren findet nicht statt.
3. Vertragsschluss
Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Abgabe einer Bestellung.
Der Vertrag kommt zustande, sobald der Kunde den Bestellvorgang abschließt und die Zahlung erfolgreich erfolgt ist.
4. Preise und Zahlung
Alle angegebenen Preise verstehen sich als Endpreise inklusive der gesetzlichen Mehrwertsteuer.
Die Zahlung erfolgt über die im Shop angebotenen Zahlungsmethoden (z. B. PayPal).
5. Lieferung / Download
Nach erfolgreichem Zahlungseingang erhält der Kunde Zugriff auf den Download der gekauften digitalen Inhalte.
Der Kunde ist selbst dafür verantwortlich, die technischen Voraussetzungen für den Download und die Nutzung der Dateien sicherzustellen.
6. Nutzungsrechte
Mit dem Kauf erhält der Kunde ein einfaches, nicht übertragbares Nutzungsrecht an den digitalen Inhalten.
Die Dateien dürfen:
- für private Zwecke genutzt werden
- nicht weiterverkauft, weitergegeben, vervielfältigt oder veröffentlicht werden
- nicht kommerziell genutzt werden, sofern nicht ausdrücklich anders angegeben
7. Widerrufsrecht bei digitalen Inhalten
Bei digitalen Inhalten erlischt das Widerrufsrecht, sobald der Kunde ausdrücklich zugestimmt hat, dass mit der Ausführung des Vertrags vor Ablauf der Widerrufsfrist begonnen wird, und seine Kenntnis vom Verlust des Widerrufsrechts bestätigt hat.
8. Haftung
Der Anbieter haftet unbeschränkt für Vorsatz und grobe Fahrlässigkeit.
Für leichte Fahrlässigkeit haftet der Anbieter nur bei Verletzung wesentlicher Vertragspflichten und begrenzt auf den vorhersehbaren Schaden.
9. Urheberrecht
Alle angebotenen digitalen Inhalte unterliegen dem Urheberrecht.
Die Rechte verbleiben beim Anbieter.
10. Schlussbestimmungen
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.
Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

1. Scope
These Terms and Conditions apply to all contracts between

and consumers or businesses for the purchase of digital content via this online shop.
2. Subject of the Contract
The subject of the contract is the sale of digital content, specifically 3D printing files (STL files).
Delivery is made exclusively via digital download.
No physical goods are shipped.
3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
The contract is concluded when the customer completes the order process and the payment is successfully processed.
4. Prices and Payment
All prices shown are final prices including applicable VAT, unless stated otherwise.
Payment is made using the payment methods offered in the shop (e.g. PayPal).
5. Delivery / Download
After successful payment, the customer receives access to download the purchased digital content.
The customer is responsible for ensuring that their system meets the technical requirements necessary to download and use the files.
6. License and Usage Rights
Upon purchase, the customer receives a non-exclusive, non-transferable license to use the digital content.
The files may:
- be used for personal use only
- not be resold, shared, distributed, or published
- not be used commercially, unless explicitly stated otherwise
7. Right of Withdrawal for Digital Content
The right of withdrawal expires once the customer has expressly agreed to the immediate performance of the contract and has acknowledged that they thereby lose their right of withdrawal.
8. Liability
The provider shall be liable without limitation for intent and gross negligence.
In cases of slight negligence, liability is limited to foreseeable damages arising from the breach of essential contractual obligations.
9. Copyright
All digital content is protected by copyright law.
All rights remain with the provider.
10. Final Provisions
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If any provision of these Terms and Conditions is invalid, the remaining provisions shall remain unaffected.
